This policy is published under California Civil Code section 1798.90.51 and describes how Valet Guide, a service of Modern Valet, LLC (“Valet Guide,” “we,” “us,” or “our”), and valet operators using the Valet Guide platform (“Operators”) use automated license plate recognition (“ALPR”) technology.
This policy governs the use of automated license plate recognition (“ALPR”) technology by Valet Guide and by valet operators using the Valet Guide platform, and the handling of the information that technology collects (“ALPR information”). Valet Guide publishes this policy as an ALPR operator; each operator using the platform adopts it by reference under the Operator Terms. It is published under California Civil Code section 1798.90.51 and applied as the platform standard in every jurisdiction in which the platform operates.
ALPR information is collected and used only to identify a guest’s vehicle for valet service: to match a vehicle to its ticket at check-in, to locate and retrieve the correct vehicle, and to resolve disputes about a specific vehicle or service. ALPR information is not used for any other purpose, and not for marketing, tracking, or profiling.
At check-in, the system reads the vehicle’s license plate number and the plate’s issuing jurisdiction, and may retain a cropped image of the plate and, when the plate reading is uncertain or the ticket is disputed, a photo of the vehicle. Vehicle make, model, and color are not collected by default. If enabled, the categories collected will be stated here before collection begins.
Plate images are retained for the operator account’s dispute window, by default 180 days and in no case longer than 730 days, after which they are automatically deleted. Vehicle photos are retained for 30 days. Where a specific dispute is open, the related image is retained no longer than that 730-day maximum, and where the dispute is resolved sooner it is deleted within 30 days of resolution. Images subject to a legal hold arising from a served claim or court order are retained for the duration of that hold. Plate numbers and vehicle details recorded on a ticket are permanently removed once that dispute window has passed after the ticket is delivered or canceled, and are kept longer only while a dispute about that ticket is open.
Valet Guide does not sell ALPR information. We share it only with the valet operator providing your service, which receives it in order to provide that service; with the third-party service provider that performs the plate recognition, which processes it under that provider’s own service terms to perform the recognition and for no other purpose at Valet Guide’s direction; and, if you dispute a card payment for the service, with the payment processor, to which a plate or vehicle image may be submitted as evidence for that dispute. ALPR information is disclosed to law enforcement only as required by law or valid legal process.
Access to ALPR information by Valet Guide and Operator personnel is restricted to authorized personnel by role, is limited to the authorized purposes above, and is recorded. Valet Guide maintains reasonable security procedures and practices to protect ALPR information from unauthorized access, destruction, use, modification, or disclosure. Access records include the identity of the person accessing the information, their affiliation, and the purpose of access. Opening a ticket, viewing a plate image, and exporting records are each recorded every time; the live vehicle queue and ticket list, which refresh automatically, are recorded once per user, per location, per 15-minute period. A guest can see the plate on their own ticket through their private ticket link.
Personnel access to ALPR information is recorded in an append-only audit log, and that log is the basis for periodic review of who accessed plate data and why. Authorized users complete a short training on the authorized purposes, access rules, and retention limits before handling ALPR information.
